This Paper sets out the legal requirements that trustees of charities in England and Wales must follow when they sell, lease or mortgage land and buildings in England or Wales. The legal requirements described in the paper take account of changes made to Charities Act 2011 by Charities Act 2022 and which were brought into force in June 2023. Whilst the rules do not apply to the acquisition of land, the Paper explains why it is advisable for charity trustees to adopt a similar approach of obtaining suitable advice on a proposed transaction involving the purchase of land and buildings.
